1. Acceptance of Terms
By accessing or using NexusLead ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. User Responsibilities
As a user of NexusLead, you must use the platform responsibly and legally. You agree to the following obligations:
- Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws, including but not limited to privacy laws and anti-spam regulations (e.g., the CAN-SPAM Act, GDPR, CCPA).
- No Spamming & Daily Limits: You must not use our service to send unsolicited commercial email (spam). All email campaigns must be sent to recipients who have opted-in or with whom you have a legitimate business interest. To enforce this, we impose a strict sending limit of 125 emails per day per user. NexusLead reserves the right to immediately suspend or terminate accounts that violate this anti-spam policy or attempt to bypass sending limits.
- Deliverability, Reputation & Acceptable Use: You are solely responsible for your recipient lists, outreach content, sending cadence, Smart Sequence configuration, and compliance posture. NexusLead is a software platform and does not guarantee inbox placement, open rates, click rates, or domain reputation outcomes. We are not liable for spam complaints, blacklisting, domain/IP reputation damage, provider throttling/suspension, or related business losses arising from your campaigns or cold outreach activity.
- App Password Authorization: By providing a Google App Password to our service, you explicitly authorize NexusLead to send automated emails on your behalf via SMTP.
- Account Security & Integrity: Account sharing is strictly prohibited. One account is licensed for use by one individual user only. Evidence of account sharing will result in immediate account termination without a refund. You are also responsible for safeguarding your password and any activities under your account.
- Data Ownership: You are solely responsible for the content and legality of the data you collect and process using NexusLead.
3. Acceptable Use & Anti-Ban Liability
Nexus Connect is provided strictly as a workflow automation tool. While our software utilizes human-like pacing and local execution to mitigate risks, NO automated messaging tool is 100% immune to bans. You (the user) are solely responsible for complying with WhatsApp's Terms of Service. NexusLead takes ZERO responsibility and is NOT liable for any account bans, suspensions, or restrictions resulting from your use of the software. Use responsibly and avoid spamming.
By utilizing the desktop application, you explicitly acknowledge that NexusLead does not control or monitor the content or volume of your communications. Any impact on your account reputation, accessibility, or technical standing with third-party messaging providers is the result of your own operational decisions and outreach strategy.
4. Subscriptions, Cancellations & Refunds
Certain parts of the Service are billed on a subscription basis ("Subscriptions"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.
Manual Payment Processing: Payments made via manual methods (Crypto/PayPal/UPI) are subject to manual verification and the account upgrade process typically takes 6 hours, but can take 24-48 hours on busy days or weekends.
Strict Action: Submitting fake or fraudulent transaction IDs during the manual payment process will result in immediate and permanent account suspension and a ban from the platform without further notice.
Cancellation Policy: You may cancel your recurring subscription at any time via the billing dashboard to prevent future charges. However, cancelling does not entitle you to a refund for the current billing cycle. You will retain access to your Pro features until the end of your already-paid billing period.
REFUND POLICY: All sales are final. We do not offer refunds, partial refunds, credits, or prorated billing for canceled accounts or unused time under any circumstances. We strongly encourage all users to fully evaluate our tool using the free tier before committing to a paid plan. By subscribing, you agree to this strict no-refund policy.
We reserve the right to change our subscription prices at any time. Any price change will become effective at the end of the then-current Billing Cycle.
5. Limitation of Liability & Service Responsibility
In no event shall NexusLead, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
Service Responsibility: NexusLead.live provides the email sending infrastructure and technical domain health verification tools. The user is solely responsible for ensuring valid SPF and DMARC records are present on their custom domain. We are not liable for emails landing in spam folders or any domain blocks resulting from misuse or missing domain records.
6. Data Retention & Auto-Deletion
To ensure system performance and privacy, NexusLead enforces a strict 30-Day Data Retention Policy.
- Any lead data generated or saved in your account will be automatically permanently deleted 30 days after its creation date.
- You are responsible for exporting or downloading your leads before this 30-day period expires.
- NexusLead provides a dashboard alert and a 'Download Backup' feature 3 days prior to deletion, but we are not liable for any data loss if you fail to take action.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
